1. INTRODUCTION

The present general terms and conditions of sale apply to all offers and product sales on the following website: www.flyingfish.store (hereafter named "the website"), owned by the company: FLYING FISH SHOP EURL, French company registration number 918 909 680 000 12 whose registered headquarters are located 6 Rue Bochart de Saron in Paris, France (hereafter "Flying Fish"). Any consumer, relating to a physical person either visiting or making a purchase via the website is hereafter called "the customer".

Customers may order items from Flying Fish’s multi-brand products on the website (hereafter "the item(s)"), according to the following general conditions.

Any order placed with Flying Fish shall therefore imply the customer's unconditional acceptance of the following terms and conditions. The present general conditions may be modified at any time and without notice by Flying Fish. See bottom of page for latest updates to these terms of sale.

 

2. PRODUCTS AND CONFORMITY

2.1 The items available for sale are available exclusively on www.flyingfish.store and are defined by a non-negociable price and product description.

2.2 The items available for purchase on www.flyingfish.store comply with standards applicable in France as our company is registered.

Flying Fish takes great care in ensuring that the items are described as accurately as possible through the photos and visuals provided on the website and on social media outlets. Product details (such as color, print shapes, or fabric and material texture) may vary depending on screen resolution and other external factors, and thus differ slightly from the item received.

Any information displayed on the website regarding sizing is for informational purposes only. Products sold on Flying Fish come from various brands and therefore may differ in sizing depending on their country of origin and manufacturing techniques. If a customer has any doubts regarding sizing, it is recommended that the customer contact Flying Fish before placing an order.

 

3. CUSTOMER RESPONSIBILITY

3.1 The customer declares that he/she is at least 18 years of age and has the legal capacity or parental permission to place an order on the website.

3.2 The customer agrees to provide Flying Fish with the information required to carry out retail services, subject to the present conditions as it is requested online and according to one’s individual situation, in particular customer’s surname, first name, address, telephone number and a valid e-mail address.

The customer is responsible for any consequences resulting from providing false, inaccurate, or even unlawful information. Identity theft shall be reported to the competent authorities.

3.3 Once the order has been placed, Flying Fish will send an e-mail to the customer confirming the order. Flying Fish shall also inform the customer of the order’s shipment and progress. In addition to the tracking number provided. Customers reserve the right to contact Flying Fish at any time to request further information on their shipment’s progress.

 

4. ORDERS

4.1 An order is only valid after payment has been accepted. No order shall be shipped prior to receiving payment.

4.2 Flying Fish reserves the right to cancel or refuse an order in the case of litigation(s) with a customer regarding previous or future orders. Orders containing more than 10 items may be subject to provide proof of identity by Flying Fish’s customer service team or be temporarily flagged for suspicious activity.

4.3 Flying Fish will only accept orders within the limits of available stock. The brand will inform the customer of the availability of the items sold on its website at the time the order is confirmed.

If, despite Flying Fish's vigilance regarding levels of stock, an item becomes unavailable, Flying Fish will inform the customer by e-mail as soon as possible. The customer will then be able to cancel his/her/their order and receive a refund, of the amount(s) already paid.

The permanent or temporary unavailability of Flying Fish products shall in no way engage Flying Fish’s responsibility, nor shall it give rise to any form of compensation in the customer’s favor.

 

5. PRICING

The prices displayed on the website are indicated in Euros, and include all French taxes (French VAT and any other applicable taxes), excluding shipping costs, handling costs and packaging costs.

The shipping, handling and packaging costs will be clearly indicated in the customer's cart, before receiving the final order confirmation.

Prices are subject to change at any given time, without prior notice. The items will be invoiced on the basis of the prices practiced at the time of registration of the order.

Discounted sales prices follow the French law’s sale calendar pertaining to mark-downs.

Promo codes provided by Flying Fish cannot be applied to sale items.

 

6. DELIVERY

6.1 Flying Fish delivers worldwide with limitations to specific countries. The delivery price and method will be calculated at the time of payment.

Within France, standard delivery is free for all orders over €150, and express delivery is free for orders over €200. For orders shipping within Europe, and international orders, please refer to the pricing table in the “Delivery & returns” section.

The items are shipped as indicated in the order confirmation details, to the delivery address provided by the customer when placing the order. The delivery timeframes indicated on the website are indicative of average handling and delivery timeframes. In order to ensure that these deadlines are respected, the customer must ensure that he/she has provided accurate and complete information regarding the delivery address (including but not limited to street name, building, floor, door codes, names and/or intercom numbers, etc.)

Flying Fish reserves the right not to deliver to any country restricted by export laws and regulations. Orders cannot be delivered to P. O. boxes or similar addresses.

Items from the same order cannot be shipped to multiple delivery addresses.

If shipping to a hotel establishment, the customer must use the hotel’s address as the recipient address. The customer must include their room number and full name in the shipping details. Flying Fish advises customers to contact their hotel’s front desk prior to shipment to inform them of the arrival of a package in their name.

International deliveries may be subject to inspection by customs authorities and import taxes to be paid upon receipt of the order (or thereafter). The customer is solely responsible for these import taxes. Flying Fish has no control over such taxes and cannot predict their amounts beforehand. The customer should contact local customs authorities for more information before placing an order.

In the event an item must be returned, import taxes will be refunded only if included in the original purchase price. If these were not included, the customer is responsible for recovering these taxes from his/her local customs authorities.

6.2 DELIVERY TIMEFRAMES

Standard Delivery in France:

Colissimo Standard requiring proof of signature, delivered 3 to 4 days after dispatch. (Metropolitan France, excluding DOM TOM)

Express Delivery in France:

Colissimo Express requiring proof of signature, delivered 1 to 2 days after dispatch. (Metropolitan France excluding both Corsica, and DOM TOM)

Pick-Up Point Delivery in France (La Poste and pick-up point/station):

Orders available for collection at a pick-up point, within 3–4 days after dispatch. (Metropolitan France and Corsica, excluding DOM TOM)

Delivery within Europe and international delivery:

DHL Express delivery within 1 to 2 days once dispatched.

N.B. With Brexit regulations in effect, customs duties policy is changing for shipments to the UK. For shipments exceeding £135 in value, customs fees will be collected at import or upon delivery to customers. This also applies if the purchased goods are not made in the UK or the EU.

 

7. PAYMENT

Payments are secured via the Paypal payment system or by credit card via Stripe (online payment processing for internet businesses).

Flying Fish accepts most credit and debit cards.

Online payments are subject to validation by the card issuer. Flying Fish cannot be held responsible if the issuer decides for any reason to decline a payment. A card pre-authorization is required at the time of payment and the items ordered will not be dispatched until this pre-authorization check has been completed. Some card issuers may request payment for online service charges, for which Flying Fish is not responsible.

 

8. RETURNS POLICY

Orders may be returned to Flying Fish within 14 days of delivery (30 days for international orders). Items must be returned in their original packaging, and should not be worn. Items that are returned incomplete, damaged, dirty, or foul-smelling will not be eligible for a refund and will be returned to the customer. Items purchased from the Souvenirs section may not be returned, unless the product has been damaged during shipment, or is defective.

Returns are free of charge under certain conditions, and a pre-paid return label is provided for all orders.

Refunds for return items are processed after receipt of the returned items. Flying Fish will provide a refund via the customer’s original payment method.

Flying Fish will refund the item(s) price in full. This amount will not include the original shipping costs paid for the purchase of the item(s) or the costs incurred by the customer for the return of the item(s) outside of France. Customs fees are the customer’s responsibility and are not subject to be reimbursed.

Returns are not accepted for items in the “Swimwear” categories, or sold as part of our Clearance/Sample Sale.

 

9. INTELLECTUAL PROPERTY RIGHTS

www.flyingfish.store is a protected domain name. No third-party entity is authorized to reproduce, use or distribute any element from the website for any purpose whatsoever, even partially, except with written consent from Flying Fish.

The website and its content must be used responsibly, in a legal manner (in accordance with all applicable laws and regulations), and should in no way attempt to harm Flying Fish’s name, reputation or that of its partners.

 

10. PERSONAL DATA PROTECTION

In accordance with France’s law relating to information technology dating from January 6, 1978, personal data collected from customers may be subject to automated processing. The customer has the right to access and rectify their personal data in accordance with the law.

A customer may request to be deleted from the brand's database, upon which request Flying Fish shall be compelled to delete all contact details and information. The data collected may not be used for commercial purposes other than those referred to on the website.

The data used for commercial prospecting purposes may be kept for a period of three years from the end of the commercial relationship.
